ESMA fund’s names guidelines: Overcome judgmental and operational challenges
By Jeremy PAGES, Partner Fabienne BRILLAND, Senior Manager at Deloitte Luxembourg   The European Securities and Markets Authority (ESMA) has published comprehensive guidelines (the Guidelines) that apply to Undertaking for Collective Investment in Transferable Securities (UCITS) management companies and Alternative Investment Fund Managers (AIFM). The Guidelines aim to enhance investor protection and mitigate greenwashing risks by proposing a stringent framework for using ESG- or sustainability-related terms in fund names, including quantitative thresholds or minimum safeguards.
