Following the recent first referral of Luxembourg Competition Authority under Article 22(1) of Council Regulation 139/2004 regarding Merger Control (“EUMR”) for the scrutiny of the European Commission (“Commission”), the issuance of the merger regime Bill no. 8296 (the “Bill”) on August 23, 2023, has increased the expectations on the merger front.
The Bill is the outcome of discussions that started in 2021, involving interministerial working groups, dialogues with national competition authorities and the Commission, and consultations with various stakeholders.
