On 4 February 2025, the European Commission released the first set of guidelines regarding the definition of artificial intelligence (“AI”) pursuant to the AI Act (the “Definition Guidelines”) and the prohibited AI practices (the “Prohibited AI Guide- lines”). These Guidelines were published further to the first wave of provisions of the AI Act entering into application on 2 February 2025 regarding prohibited AI practices and AI literacy, both of which require an understanding of what constitutes a (prohibited) AI or not.
