Overview of new CSSF Regulation no. 12-02 on anti-money laundering (AML) and counter terrorist financing (CTF): Evolution, not revolution
Since the third Financial Action Task Force (FATF) AML/CTF mutual evaluation report of Luxembourg was issued in February 2010, the Luxembourg authorities have been quick to react by launching a series of legislative measures to address the issues raised. This new regulation is a step further in this direction as it enhances the Luxembourg AML/CTF legal and regulatory framework designed to protect the Luxembourg financial centre.   But Regulation no. 12-02 (hereafter the “Regulation”) doesn’t really introduce significant new measures compared to the now repealed CSSF Circulars. The recently released Regulation has mainly transposed several existing professional obligations into a legally binding document. CSSF Circulars 08/387 and 10/476 have consequently been repealed....
