The AIFMD 2 Proposal – New Rules for Loan-originating AIFs
By Dr. Sebastiaan Niels Hooghiemstra*   On 25 November 2021, the European Commission published proposals to amend Directive 2011/61/EU (“AIFMD 2”) and Regulation (EU) 2015/760 (“ELTIFR (2)”)). AIFMD 2 proposes to (directly) introduce new rules for loan-originating alternative investment funds (“AIFs”), whereas the changes proposed by ELTIFR (2) will impact only those loan-originating AIFs authorized in accordance with ELTIFR (2).
