On 10 November 2023, the text of an amending directive that will make amendments to Directive 2011/61/EU was published. This amendment directive is being referred to as “AIFMD 2”. AIFMD 2, amongst others, introduces new rules for loan-originating alternative investment funds (“AIFs”), AIFs which originate loans (“AIFs-WOL”) and alternative investment fund managers (“AIFMs”) managing AIFs-WOL (“LO-AIFMs”). This contribution provides an overview of the key aspects of these new rules under AIFMD 2.
