The ELTIFR 2 Proposal – A Revived European Legal Framework for Regulated Professional and Retail AIFs
By Dr. Sebastiaan Niels HOOGHIEMSTRA*   On 25 November 2021, the European Commission published a proposal to amend Regulation (EU) 2015/760 (“ELTIFR 2”). ELTIFR 2, in particular, overhauls the rules applicable to eligible assets, portfolio composition and the distribution to retail investors. In doing so, ELTIFR 2 clearly distinguishes between European long-term investment funds (“ELTIFs”) that are to be marketed to “professional investors” and “retail investors”, including high-net-worth individuals (“HWNI”).
