New CSSF Requirements for (Luxembourg) Investment Funds investing in Crypto-Assets
By Dr. Sebastiaan HOOGHIEMSTRA Gabriël STORM*   The Commission de Surveillance du Secteur Financier (“CSSF”) adopted on February 2026 the FAQ “FAQ Crypto-Assets – Undertakings for collective investment” (the “2026 FAQ”), replacing and updating the CSSF FAQ of 29 November 2021 on “Virtual Assets – Undertakings for Collective Investment” (the “2021 FAQ”). The new 2026 FAQ complements the CSSF FAQ “Virtual Assets – Credit Institutions” (the “FAQ-CI”), which remains relevant, in particular, for credit institutions acting as depositaries.
